Terms and Conditions

1. Agreement to Terms
These Terms and Conditions ("Terms") govern your use of this website and any design, development, or related services ("Services") provided by Chris Paynaganan, operating from the Philippines ("we," "us," or "I"). By visiting this site, submitting an inquiry, or engaging our Services, you agree to these Terms. If you do not agree, please do not use this site or engage our Services.
2. About Us
Chris Paynaganan is an independent product designer and developer, operating under his own name, based in the Philippines, providing UX/UI design, website design and build, and related digital product services to clients worldwide.
3. Services
We offer product design, website design and development, and related services as described on our Services page, including the bundle tiers, pricing, and add-ons listed there. The specific scope, deliverables, and timeline for any engagement are confirmed directly with you before work begins, based on the information you provide through our inquiry form or in direct communication.
4. Getting Started
Engagements typically begin with an inquiry submitted through our Contact page. We respond directly -- usually within a day or two -- to discuss your project, confirm scope, timeline, and pricing, and agree on next steps before any work begins.
5. Fees and Payment
Pricing for each service tier, along with the available payment plans -- full payment, three monthly installments, or a 50/50 split -- is listed on our Services page. Whichever plan you choose, the first payment is required upfront, before work begins.
6. Revisions
The number of included revision rounds is specified per bundle on our Services page. Requests outside the agreed scope, or additional rounds beyond what's included, may be billed separately. Minor clarifications and quick fixes are not counted as a formal revision round.
7. Cancellations and Refunds
Either party may terminate an engagement in writing at any time. How a refund works depends on how you're paying:
- Your first payment, under any plan, is non-refundable once work has begun -- it reserves your project and covers the work already started.
- If you're on the three-month installment plan or the 50/50 split, and you cancel after making a later payment, that later payment will be refunded to you in full.
- If you paid in full upfront and choose to cancel, you'll receive a refund of 80% of the total amount paid.
8. Intellectual Property
Upon receipt of payment in full, ownership of the final approved deliverables transfers to you, the client, for your intended use. We retain the right to display the work in our portfolio, case studies, and marketing materials, unless agreed otherwise in writing (for example, under an NDA). Any underlying tools, code libraries, templates, or design systems we bring into a project that existed before the engagement remain our property, licensed to you for use within the delivered project.
9. Client Responsibilities
To keep your project on schedule, you agree to provide timely feedback, necessary content (copy, images, brand assets, account access, etc.), and clear direction when requested. Delays in providing these may affect project timelines.
10. Confidentiality
We treat all project details, business information, and materials you share with us as confidential, and will not disclose them to third parties without your consent, except as required to deliver the Services (for example, to our hosting or email providers) or as required by law.
11. Warranties and Limitation of Liability
Services are provided on an "as is" basis. While we take care to deliver quality work, we do not guarantee specific business outcomes (such as traffic, conversions, or revenue) resulting from the Services. To the fullest extent permitted by law, our total liability for any claim arising from these Terms or the Services is limited to the amount you paid us for the Services giving rise to the claim.
12. Termination
We reserve the right to decline or discontinue a project at our discretion, including if a client's requests fall outside what we can reasonably deliver, or if payment terms are not met. In such cases, you will be invoiced for work completed to date.
13. Governing Law
These Terms are governed by the laws of the Republic of the Philippines. Any disputes arising from these Terms or our Services are subject to the exclusive jurisdiction of the courts of Manila.
14. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent changes. Continued use of this site or our Services after changes are posted constitutes acceptance of the updated Terms.
15. Contact Us
